| 1. | The seller shall not be held responsible if it ， owing to force majeure cause fails to make delivery within the time stipulated in the contract or can not deliver the goods

| 3. | The person entitled to make a claim for the loss of goods may treat the goods as lost when the carrier has not delivered the goods within 60 days from the expiry of the time for delivery specified in paragraph 1 of this article

| 4. | B in case of non - delivery , if the seller does not deliver the goods within the additional period of time fixed by the buyer in accordance with paragraph of article 47 or declares that he will not deliver within the period so fixed

| 5. | 3 when article 10 . 2 does not apply and the seller has not delivered the goods by the date on which the buyer has become entitled to the maximum amount of liquidated damages under article 10 . 1 , the buyer may give notice in writing to terminate the contract as regards such goods , if they have not been delivered to the buyer within 5 days of receipt of such notice by the seller
